RIGHT OF WITHDRAWAL

If the Customer who made a purchase on www.portofinofinefood.it is a Consumer customer, he has the right to withdraw from the purchase contract, without giving any reason, within 10 days. The withdrawal period expires 10 days from the day on which the The Buyer Consumer himself or a third party designated by him, other than the carrier, acquires physical possession of the goods. In the case of contracts relating to the delivery of multiple goods, ordered by the Buyer Consumer in a single order and delivered separately, or of a good consisting of multiple lots or pieces, the right of withdrawal expires after 10 days from the day on which the Consumer Purchaser himself or a third party designated by him, other than the carrier, acquires physical possession respectively of the last product, or lot or piece. To exercise the right of withdrawal, the Consumer Purchaser is required to inform Portofino Industrie Alimentari srl of his explicit decision to withdraw from the contract by registered letter with return receipt, addressed to ca. Ordini Web, Portofino Industrie Alimentari Srl, Via Dogali 58 A/2, 16038 Santa Margherita Ligure (GE), or by mail to the following email address info@portofinofinefood.it. To comply with the withdrawal deadline, it is sufficient for the Consumer Purchaser to send the communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal.

Effects of withdrawal

If the Consumer Purchaser withdraws from the contract, all payments he has made to Portofino Industrie Alimentari Srl will be refunded, including delivery costs where foreseen (with the exception of additional costs deriving from the possible choice of the Consumer Purchaser for a type of delivery other than the least expensive type of standard delivery proposed by Portofino Industrie Alimentari Srl), without undue delay and in any case within 10 days from the date on which Portofino Industrie Alimentari Srl received the notice of withdrawal. The refund will be made using the same means of payment used by the Consumer Purchaser for the initial transaction, unless he has expressly agreed otherwise; in any case, the Purchasing Consumer will not have to incur any costs as a result of this refund. The refund may be suspended until the actual receipt of the goods. If the Purchasing Consumer has already received the goods, he will have to return or deliver the goods to Portofino Industrie Alimentari Srl , Via Dogali 58 A/2, 16038 Santa Margherita Ligure (GE), without undue delay and, in any case, within 14 days from the day on which you communicated the withdrawal to Portofino Industrie Alimentari Srl. The deadline is met if the Buyer-Consumer sends back the goods before the expiry of the 10-day period. The direct costs of returning the goods will be borne by the Buyer-Consumer. The Buyer-Consumer is only liable for the diminished value of the product resulting from of the product other than that necessary to establish its nature and characteristics.

Exclusions

The right of withdrawal is excluded, as well as in cases where the customer is not a consumer pursuant to the Consumer Code, or requests an invoice, or in the event that the consideration does not exceed 50 euros, also in the case of:

• order for Products which are likely to deteriorate or expire rapidly;
• order for sealed Products which are not suitable for return for hygienic or health protection reasons or which have been opened after delivery.
• order for personalized Products at the request of the Buyer Consumer

The right of withdrawal applies only to Products purchased on the Website www.portofinofinefood.it/store which can be returned to Portofino Industrie Alimentari Srl and put back on the market without endangering the health of consumers.
